Areas of Practice

EMPLOYMENT LAW

We represent management in all facets of the employer-employee relationship. We counsel, train, and litigate all aspects of employment law. We assist clients to avoid litigation by counseling them in advance of significant employment decisions, and we help our clients design programs and policies to foster positive employee relations.

Our experience includes advice and litigation in employment discrimination cases before the EEOC, state and local human rights commissions, and the courts; arbitration of union grievances; minimum wage and overtime audits by the U.S. Department of Labor; litigation under the Fair Labor Standards Act; and the litigation and trial of a wide range of employment-related claims including wrongful termination, breach of contract, defamation and violations of whistleblower laws.

We strive to provide exceptional value at every stage of an employment law problem:

AS ADVISORS

Our focus is to help each client identify the best available business solution with the least legal risk. Our advice is not just based on laws and regulations and our many years of counseling clients, but also on the practical impact client decisions are likely to have on a judge, a jury or a regulator down the road. We can do this because we have tried and won numerous administrative, bench and jury trials for companies of all sizes in many different industries, from the fortune 500 to small businesses.

AS ADVOCATES

We have experience before mediators, arbitrators, judges and juries in state and federal courts. We defend age, race, sex, national origin, disability discrimination and harassment claims. We defend claims under the state and federal wage and hour laws. We have obtained numerous defense verdicts and decisions. We do not get cold feet on the courthouse steps.

BUSINESS LITIGATION

We prosecute and defend claims in a variety of significant business disputes and litigation, which often involve claims of breach of contract; business torts; enforcement of confidentiality, non-compete and non-solicitation agreements; allegations of misappropriation of trade secrets, fraud and breach of fiduciary duty.

We also handle business litigation cases that include claims for breach of contract, including mortgage and other real estate agreements, warranty agreements, executive employment agreements, non-disclosure agreements, corporate and partnership agreements and sales contracts.

ALTERNATIVE DISPUTE RESOLUTION

Mr. Stacy serves as an arbitrator on the Commercial Panel of the American Arbitration Association, where he hears employment and contract cases.  He is also a certified mediator, handling a wide variety of disputes.
